AN INVESTIGATION OF THE CAUSES AND THE EFFECT OF INDUSTRIAL DISPUTE ON THE ADMINISTRATION OF TERTIARY INSTITUTIONS

INTRODUCTION

1.1  Background Of The Study

In recent years, the educational sector, particularly universities in Nigeria, has been besieged by constant closures due to labor disputes. According to Adeniran (2011), an industrial dispute occurs when labor and the government or employers disagree, or when employers and employees disagree, or when the government fails to implement workplace conditions and other agreements reached between labor and the government. The protracted labor conflict between the government and academic employees at Nigerian universities is a typical example (Chijioke, 2013). While some researchers have argued that industrial disputes are necessary to stimulate changes in service quality and innovation at tertiary institutions, the negative consequences are always reflected in the institution’s low rankings. academic standards are jeopardized because academic learning is disrupted (Davar, 2008). Conflict occurs when two or more parties have competing interests in resource ownership and distribution, as well as other aspects of development. According to Ogbuka (2010), disputes can be sparked by employees, students, management, or labor unions. According to Gouldner (2013), disagreements can arise between management and labor, as well as between students and faculty at postsecondary institutions, and even between a school and its host community. Furthermore, labor disputes can arise between union leaders and management, as well as between management and union leaders. Employees go on strike and management and employers go on lockout when there is industrial strife. Industrial conflict, according to Akpala (2012), is any disagreement or conflict.

1.2 Statement of the Issue

According to Aninih (2000), industrial disputes signal the end of amicable relations between labor and management. There are consequences to industrial action. As a result, it is expected that industrial activities will force management to change its stance and advocate for labor demands. Furthermore, it is expected that such activities will improve working conditions and overall productivity. According to Akpala (2012), industrial actions are collective work stoppages by employees with the goal of compelling management to yield to employee requests that impede the smooth operation of academic calendars at tertiary institutions. Furthermore, this action interferes with students’ ongoing education and academic activities at school. As a result, the primary focus of this research is on the causes and consequences.

1.3 The Study’s Objectives

The overall goal of this study is to critically examine the causes and effects of industrial disputes on tertiary institution administration. As a result, the research will be focused on the following specific goals:

1. Determine the extent to which industrial disputes occur in Nigerian tertiary institutions.

2. Describe the causes of industrial disputes in Nigerian tertiary institutions.

3. Determine how industrial disputes affect administration in Nigerian tertiary institutions.

1.4 Research Issue

The following questions will be addressed during the course of this research.

1. To what extent do industrial disputes occur in Nigerian tertiary institutions?

2. What are the major causes of industrial conflict in

Nigerian tertiary institutions?

3. How does a labor dispute affect administration in Nigerian tertiary institutions?

1.5 The Study’s Importance

The study advocates for industrial harmony in our academic institutions because industrial disputes put tertiary institutions in a bind, lowering the quality of our education.

Furthermore, it will be used as a literature review by subsequent researchers. This means that other students who decide to conduct research in this area will be able to use this study as available literature that can be critically reviewed. Invariably, the study’s findings add significantly to the body of academic knowledge about the causes and effects of industrial disputes on tertiary institution administration.

1.6 The Scope Of The Study

This study is designed to look into the causes and effects of industrial disputes on tertiary institution administration. However, the study will determine the extent to which industrial disputes occur in Nigerian tertiary institutions, outline the causes of industrial disputes in Nigerian tertiary institutions, and determine how industrial disputes affect administration in Nigerian tertiary institutions.

This study will be limited to two (2) Abia State tertiary institutions.

1.7 Study Restrictions

The researcher encountered minor constraints while conducting the study, as with any human endeavor. Inadequate funds tend to impede the researcher’s efficiency in locating relevant materials, literature, or information, as well as in the data collection process, which is why the

The researcher had to settle for a small sample size. Furthermore, the researcher conducted this study while also working on other academic projects. As a result, the time spent researching will be reduced.

1.8 Terminology Definitions

Industrial Relations: Industrial relations are defined as the study of job-regulation institutions.

Industrial Dispute: Industrial Disputes as defined by the industrial Act of 1947 stated that it is Any dispute arising from the discrepancy or disagreement between labor and the government or employers, or between employers and workmen, resulting from the non- implementation of the condition service of employment and other agreement entered into between labor and the government. A typical example is the ongoing labor dispute between the government and academic staff.
