Gun Control Law: The Way Forward To End Herdsmen Banditry In Nigeria

Chapter One

Preface

Background Of The Study

Gun laws in Nigeria are frequently legislated with the intention of reducing the use of small arms in felonious exertion, specifying munitions perceived as being able of inflicting the topmost damage and those most- fluently concealed( similar as handguns and other short- barreled munitions). Persons confined from legal access to arms may include those below a certain age or having a felonious record. Arm licenses may be denied to those felt most at threat of harming themselves or others, similar as persons with a history of domestic violence, drunkenness or substance abuse, internal illness, depression or tried self-murder. Those applying for a arm license may have to demonstrate capability by completing a gun- safety course and show provision for a secure position to store munitions( NoahA. 2020). Countries which regulate access to arms will generally circumscribe access to certain orders of arms and also circumscribe the orders of persons who may be granted a license for access to similar arms. There may be separate licenses for stalking, sport firing(a.k.a. target firing), tone- defense, collecting, and concealed carry, with different sets of conditions, warrants, and liabilities.

Down from the Fulani’s origins and way of life. The Fulani, who were formerly peaceful and vagrant, sounded to have changed their strategy and station to going about their life to where firing and hijacking play a part in pastoralism yielding to increase in banditry conditioning. Banditry is a type of systematized crime committed by outlaws generally involving the trouble or use of violence.

The present experience in Nigeria attests to a change in gospel of the group. Where the Fulani in the course of carrying out their pastoral vagrant conditioning have changed tactics from bare land grazing to barrel- convinced- land grazing, from staff to gun. Armed Herdsmen migrating into the savannah and rain timbers of the central and southern countries are moving into regions where high population within the last decades has heightened pressure on cropland, adding the frequence of controversies over crop damage, water pollution and cattle theft and In the absence of mutually accepted agreement mechanisms, these disagreement decreasingly turn violent.

still this has brought to multitudinous question to as, Is Nigeria Gun Control Law effective as quested in the Act of Chapter 146 Laws of the Federal Republic of Nigeria 1990, how did the herders, bandit and terrorist groups get to carry this ordnance? What are the sources of these arm? And other affiliated question. Hence if Nigeria has a Gun control law, why are those who are in possession of arms not delved and brought to bespeak. Why is there increase in possession of arm by herders without licence?. if banditry will ever end also it must start by diving gratuitous possession of fire arms by individualities without registered or certified as this would help to track whomsoever that fire arm. thus it’s upon this premise that this exploration seek to examine Gun Control Law the way forward to end herders banditry in Nigeria.

Statement Of The Problem

The spread of violence into southern countries is exacerbating the formerly strained ties among the country’s major indigenous, ethnical and religious groups. The maturity Christian communities in the south are resentful of the affluence of substantially Muslim herdsmen, who are depicted in some narratives as a ‘‘ Islamisation force.” Herders are generally Fulani, which adds an ethnical dimension to the conflict.

More so the rising instability in the northwest — vicious attacks on original communities and hijacking of people by felonious groups in the region is being described by state officers as banditry. In malignancy of government sweats, the security situation in Nigeria is deteriorating. Indeed, the moping conflict between herdsmen and growers in north-central Nigeria has been rated six times deadlier than the Boko Haram insurrection. The recent rapes of schoolboys in Kankara community, Katsina State and in Niger State are further exemplifications of the deplorable state of security in the country.

True, Nigeria needs gun control. We can not continue to live in this gun- dominated society where life can be cut short at the least egging ( NoahA. 2020). On the other hand, for the current gun control sweats to be successful they mustn’t only be transparent; but they must also be seen to be transparent. rather of any form of double standard, the rule of engagement must be thesame. The Fulani herders, the bandit groups, terrorist groups, zealots, and, indeed, every Nigerian, must come under the laws. There must be an unprejudiced and unprejudiced arbiter, presumably a commission of prestigious Nigerians, to apply compliance. Illegal possession of ordnance and sources of arms, manufacturing, importation and deals of gun should be delved if banditry want to be checked in Nigeria. thus it’s against this background that this study is set to examine Gun Control Law the way forward to end herders banditry in Nigeria.

Ideal Of The Study

The focus of this study is to examine Gun Control Law as the nostrum to end herders banditry in Nigeria. Specifically the study will examine if the established gun control Act have been effective in Nigeria. It’ll probe the rate of herders possession of Gun in Nigeria. It’ll examine if high rate of arm possession by herders results to banditry. It’ll probe if Gun Control Law can check the rate of herders banditry.

Significance Of The Study

This study will be significant to policy makers on the need to readdress the Gun Control Act in regard to bridling the gratuitous possession of arms by herders without enrollment or license which makes carrying out of violent crimes easy. It’ll awaken the Government on the need to establish an unprejudiced and unprejudiced arbiter, presumably a commission of prestigious Nigerians, to apply compliance. It’ll enable law enforcement agencies to trace the source of gun in the country, trace sources of gun in the country, track manufacturers of original ordnance and bring to bespeak those caught enjoying and firing arms. The study will contribute to the body of knowledge, serving as a reference material, and give occasion for farther academic exploration on this field.

Compass Of The Study

The compass of this study is to examine Gun Control Law as the nostrum to end herders banditry in Nigeria. Specifically the study will examine if the established gun control Act have been effective in Nigeria. It’ll probe the rate of herders possession of Gun in Nigeria. It’ll examine if high rate of arm possession by herders results to banditry. It’ll probe if Gun Control Law can check the rate of herders banditry. still the study is demarcated to a named Original Goverment in Ebonyi State.

Exploration Question

The following exploration question attendants the study

1. What’s the extent of herders possession of ordnance in Nigeria?

2. Do you suppose that the high rate of arm possession by herders has results to banditry?

3. Do you suppose there’s a need to readdress the established gun control Act of Chapter 146 Laws of the Federal Republic of Nigeria 1990?

4. Do you suppose that Gun Control Law can check the rate of herders banditry.

5. Do you suppose that Gun Control Law is a nostrum to end the current herders banditry conditioning?

Limitation Of The Study

The following factors poses to be a limitation during the course of this exploration

fiscal constraint – inadequate fund tends to stymie the effectiveness of the experimenter in sourcing for the applicable accoutrements , literature or information and in the process of data collection( internet, questionnaire and interview).

Time constraint – The experimenter will contemporaneously engage in this study with other academic work. This accordingly will cut down on the time devoted for the exploration work.
